Job description

Position:

Legal Counsel, Employment/Labor (India)

Job Description:

What You’ll Be Doing:

The Legal Counsel, Employment/Labor will serve as the primary legal advisor for our India operations on a wide range of employment and labor law matters.  This role operates out of the Bangalore office.  The role requires a skilled, India-qualified lawyer to provide proactive, commercially focused legal advice that aligns with both Indian regulations and the company's global policies and risk tolerance. The ideal candidate must be capable of working both independently and collaboratively with the U.S.-based legal and global HR teams.

  • Regional Employment Expertise: Advise internal stakeholders on the full spectrum of employment law updates, changes, and implications, with specific focus on transitioning from legacy labor laws to the new Labor Codes (Code on Wages, Industrial Relations, Social Security, and Occupational Safety).  This includes advising on assessment of salary components and updating employment contracts, appointment letters, and other employment policies/handbooks as consistent with changing laws.
  • Legal Counsel Scope: Provide timely and strategic legal advice to the India HR team and local management on all aspects of the employment lifecycle, including recruiting, hiring, onboarding, performance management, restructuring, redundancy, and disciplinary action.
  • Compliance and Risk Management: Proactively identify and mitigate legal risks related to all employment matters.  Evaluate and advise on the engagement of non-employee labor to reduce risks related to worker misclassification and potential joint employer claims.
  • Oversee Investigations of Legal Matters: Conduct or assign investigations into employee legal complaints of harassment, discrimination, and retaliation, as well as POSH (Prevention of Sexual Harassment) across various jurisdictions in India.
  • Cross-Functional Collaboration: Partner closely with HR and other cross-functional teams to deliver effective and compliant solutions related to employment matters. Collaborate with the broader global legal team to ensure alignment between local implementation and global legal strategies.
  • Training and Education: Develop and deliver training sessions on employment law topics for HR and business leaders to build internal expertise and promote best practices.
  • Manage outside counsel and litigation. Retain and manage outside legal counsel for employment litigation and specialized legal matters. Monitor adherence to legal budgets and alignment of legal strategies with business objectives.

What We Are Looking For:

  • Education: Degree: Bachelor of Laws (LL.B.) or Master of Laws (LL.M.) from a recognized institution.
  • Experience: 5-7 years of post-qualification experience with significant focus on Indian labor and employment law, preferably gained at a top-tier law firm or in-house at a multinational company.
  • Preferred: Passed the All India Bar Examination (AIBE) within two years of provisional registration and obtained a permanent Certificate of Practice (CoP) from the Bar Council of India unless started in or until transitioned to a full-time salaried in-house position in which case Certificate of Practice no longer necessary.
  • Skills:
    • Deep expertise and working knowledge of Indian labor and employment laws.
    • Proven ability to provide practical, solution-driven legal advice that balances risk mitigation with commercial needs.
    • Experience advising large, multinational organizations is preferred.
    • Excellent analytical, research, and legal drafting skills.
    • Fluency in English, with outstanding written and verbal communication skills.
    • Self-motivated and able to thrive in a dynamic, fast-paced, and demanding work environment.
    • High degree of professional ethics and integrity.

Reporting Structure and Collaboration:

  • Act as a trusted partner to the U.S. legal team, providing comprehensive and timely updates on legal developments and risk matters in India.
  • Work collaboratively with the global HR team, local HR partners, and other internal departments.
  • Participate in regular meetings and knowledge-sharing initiatives with the U.S. employment legal team.
